I found what looks like a small tortioseshell. Whats wrong? Looks weird. Is it a small tortoiseshell?

This looks like a Small Tortoiseshell to me - with its hindwings missing. Poor critter

Thought about it and I think they got "sticky" and stuck to front wings. This looks similar to the one I saved from a barn spider web yesterday! Poor thing.
